This definitely sounds like more of an anti-hero than a villain - fun, definitely! But I would consider the Punisher ineligible for the same reasons. (However, if you can cite a specific run of comics where he is Umambiguously Villainous, I will consider changing my mind! Comics is a tricky fandom like that - so much depends on the writer and the universe and the context.)
